In the last few years, the EU has experienced several challenges to the authority of its constitutional order. Some governments began to disregard decisions made by EU institutions. These challenges have received both a political and a legal response, which culminated in the summer and fall of 2021 when the European Court of Justice imposed a fine of one million Euro per day on Poland for not respecting earlier decisions of the Court. The stalemate still has to be resolved, and it is difficult to see a clear way out that would not seriously harm the credibility of either the EU or the recalcitrant states. Mr. Auersperger Matić’s talk will shed light on the background of the rule of law crisis and explained the political and legal considerations involved. His presentation will also cover the Court of Justice and the supremacy of the Rule of Law.
